I accept and assume all risk for me and my minor child(ren) to participate in the sailing experience. In consideration of me and my children being permitted to participate in the activities being offered by Sail Newport, being of lawful age, on behalf of my child(ren), release, waive any claim against, discharge and covenant not to sue Sail Newport, the State of Rhode Island, their officers and directors, their employees, servants, volunteers, agents or any owner of any boat used by Sail Newport, the State of Rhode Island, their heirs, administrators and executors (hereinafter collectively referred to as releasees and agree not to hold any of the above named releasees liable for any claim including but without limitation, any claim for bodily or personal injuries, known or unknown, death or property damage resulting or arising from an accident or event which may occur while on, or boarding, or disembarking from any boat or facility used by the above described releasees or as a result of my participation in activities conducted by the releasees whether caused solely or in part by the negligence, gross negligence or intentional conduct of the releasees. I agree to indemnify the releasees and each of them from any loss, liability, damage or cost they may incur due to my, or my child(ren)’s participation whether caused solely or in part by the negligence, gross negligence or intentional conduct of the releasees. I hereby assume full responsibility for and risk of bodily injury, death or property damage due to negligence of the releasees or otherwise while participating in activities conducted by the releasees named parties or where I or my child(ren) is/are present on their premises. I expressly agree that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the law and that if any portion of this agreement is held invalid, it is agreed that the balance shall notwithstanding continue in full legal force and effect I FURTHER STATE THAT I HAVE CAREFULLY READ THE RELEASE AND KNOW THE CONTENTS OF THIS RELEASE AS IT RELATES TO ME AND MY CHILD AND SIGN THIS RELEASE AS MY OWN FREE ACT TO PARTICIPATE IN THE SAID ACTIVITY/EVENT. I FURTHER RELEASE ALL OF THE RELEASEES FROM ANY CLAIM WHATSOEVER ON ACCOUNT OF FIRST AID, TREATMENT OR SERVICES RENDERED BY THEMTO ME OR MY CHILD(REN) THIS RELEASE CONTAINS THE ENTIRE AGREEMENT BETWEEN THEPARTIES TO THIS AGREEMENT AND THE TERMS OF THIS RELEASE ARE CONTRACTUAL AND NOT A MERE RECITAL. PHOTO AUTHORIZATION I do hereby irrevocably consent to and authorize the use and reproduction by Sail Newport, or anyone authorized by Sail Newport, of any and all photographs taken of me or my child(ren) in all forms and media and for any purpose whatsoever without further consideration. En consideración de mí y mis hijos se les permita participar en las actividades que se ofrecen por Sail Newport, siendo mayor de edad, en nombre de mi hijo (s), la liberación, renunciar a cualquier reclamación en contra, la descarga y el pacto de no demandar a Sail Newport, el Estado de Rhode Island, sus funcionarios y directores, sus empleados, servidores, voluntarios, agentes o cualquier propietario de cualquier barco utilizado por Sail Newport, el Estado de Rhode Island, sus herederos,administradores y albaceas (en lo sucesivo denominados colectivamente & exonerados) y estoy de acuerdo en no responsabilizar a ninguno de los exonerados arriba mencionados por cualquier reclamación, incluyendo pero sin limitarse a, cualquier reclamación por lesiones corporales o personales, conocidas o desconocidas, muerte o daños a la propiedad resultantes o derivados de un accidente o evento que pueda ocurrir mientras esté en, o embarque, o desembarque de cualquier barco o instalación utilizada por los exonerados arriba descritos o como resultado de mi participación en actividades realizadas por los exonerados ya sea causada únicamente o en parte por la negligencia, negligencia grave o conducta intencional de los exonerados. Acepto indemnizar a los exonerados y a cada uno de ellos por cualquier pérdida, responsabilidad, daño o coste en que puedan incurrir debido a mi participación o la de mi(s) hijo(s), ya sea causada única o parcialmente por la negligencia, grave o conducta intencionada de los exonerados. Por la presente asumo toda la responsabilidad y el riesgo de lesiones corporales, muerte o daños a la propiedad debidos a la negligencia de los exonerados o de otro tipo durante la participación en actividades realizadas por las partes nombradas por los exonerados o en las que yo o mi(s) hijo(s) estemos presentes en sus instalaciones. Acepto expresamente que este acuerdo de exoneración, renuncia e indemnización pretende ser tan amplio e inclusivo como lo permita la ley y que, si alguna parte de este acuerdo se considera inválida, se acuerda que el resto continuará, no obstante, en pleno vigor y efecto legal. ASIMISMO, DECLARO QUE HE LEÍDO DETENIDAMENTE LA EXENCIÓN DE RESPONSABILIDAD Y QUE CONOZCO SU CONTENIDO EN LO QUE SE REFIERE A MÍ Y A MI HIJO, Y FIRMO ESTA EXENCIÓN DE RESPONSABILIDAD COMO ACTO LIBRE PARA PARTICIPAR EN DICHA ACTIVIDAD/EVENTO. ASIMISMO, EXIMO A TODOS LOS EXONERADOS DE CUALQUIER RECLAMACIÓN POR LOS PRIMEROS AUXILIOS, TRATAMIENTO O SERVICIOS PRESTADOS POR ELLOS A MÍ O A MI(S) HIJO(S) ESTA EXONERACIÓN CONTIENE EL ACUERDO COMPLETO ENTRE LAS PARTES DE ESTE ACUERDO Y LOS TÉRMINOS DE ESTA EXONERACIÓN SON CONTRACTUALES Y NO UN MERO CONSIDERANDO. AUTORIZACIÓN PARA FOTOGRAFÍAS Por la presente consiento irrevocablemente y autorizo el uso y reproducción por Sail Newport, o cualquier persona autorizada por Sail Newport, de todas y cada una de las fotografías tomadas de mío de mi(s) hijo(s) en todas las formas y medios de comunicación y para cualquier propósito sin ninguna otra consideración.
